State Sen. Jennifer B. Boysko has introduced a measure intended to enhance communication of guardianship appointments and modifications to relevant state and local agencies, according to the Virginia State Senate.

The legislation, filed as SB216 on Jan. 14, 2026, during the 2026 regular session, is officially titled: “Guardianship; copy of appointment, termination, or modification order.”

Essentially, the measure updates state guardianship law to require circuit court clerks to provide a copy of any guardianship appointment, termination or modification order to the Department of Medical Assistance Services, in addition to the entities already involved. The clerk must promptly send the order and certificate of qualification to both the local department of social services for the individual’s residence and the department of medical assistance whenever a guardian is appointed. It also mandates similar notifications to the original and current local social services departments, as well as the department of medical assistance, when a guardianship ends or is changed.
